The registered trademark symbol, designated by is a symbol used to provide notice to others that the preceding mark is a trademark or service mark that has been registered with a national trademark office. It is illegal to use the registered trademark symbol unless you actually have a registration for the mark.
When I saw the faqs with the registered trademark symbol I immediately became suspect as my own personal research and experience has shown that the United States Patent and Trademark office shys away from registration of generic terms

As someone who has used the term Structured Settlement FAQ since 2000 on our what is structured settlement, I am aware that many others use this term. Your actions could lead to our firm and many others being falsely mischaracterized as infringers by your claim.
I am suspect that the USPTO would agree to registration of such a generic term when it refused to register a term such as "the structured settlement company" to EPS Settlements Group , one of whose predecessors carried the name.
On behalf of my company and in my capacity as the structured settlement industry watchdog I demand that you provide proof of the registration with the USPTO or cease and desist claiming a registered trademark in the term unless you do in fact have one" structured settlement loan.
