"Structured Settlement Faqs" Registered Trade Mark? - Finance - PersonalFinance

A company called is claiming a registered trademark for the generic term ". The registered trademark symbol, designated by is a symbol used to provide notice to others that the preceding mark is a trademark or service mark that has been registered with a national trademark office. It is illegal to use the registered trademark symbol unless you actually have a registration for the mark.

When I saw the faqs with the registered trademark symbol I immediately became suspect as my own personal research and experience has shown that the United States Patent and Trademark office shys away from registration of generic terms

At the time of this posting, a search for, or settlement faqs DOES NOT come up as a pending or an actually registered mark on the website of the United States Patent and Trademark Office. See for yourself here The website lists a Sarah Lawson as founder and a mailing address in Southampton New York. Yet a phone search for Southampton New York comes up with no listing for a Sarah Lawson or A Google search for Sarah Lawson comes up with a Twitter account Sarah , but clicking on the link at the time of posting shows that the Twitter account is suspended. "You post the registered trademark symbol after on your website,what are structured settlements, the domain for which was registered August 17, 2011.

Yet a search at the USPTO website shows no such registration. There is no phone number in a phone directory search for Sarah Lawson or in Southampton New York and your domain registration is anonymous

As someone who has used the term Structured Settlement FAQ since 2000 on our what is structured settlement, I am aware that many others use this term. Your actions could lead to our firm and many others being falsely mischaracterized as infringers by your claim.

I am suspect that the USPTO would agree to registration of such a generic term when it refused to register a term such as "the structured settlement company" to EPS Settlements Group , one of whose predecessors carried the name.

On behalf of my company and in my capacity as the structured settlement industry watchdog I demand that you provide proof of the registration with the USPTO or cease and desist claiming a registered trademark in the term unless you do in fact have one" structured settlement loan.
